Frequently asked questions

Oklahoma divorce questions, answered.

Straight answers about cost, timing, and what it takes to get an affordable uncontested divorce in Oklahoma.

How much does a divorce cost in Oklahoma?

An uncontested divorce through Express Divorce Services costs $159.95 without minor children or $259.95 with minor children, plus the $252.13 Oklahoma court filing fee that you pay to the court. That puts the total at about $412 without children or $512 with children.

If your spouse cannot be located, our fee is $209.95. If you have minor children and want to ask the court to waive the 90-day waiting period, add $50. See the full Oklahoma divorce cost breakdown.

What is the cheapest way to get a divorce in Oklahoma?

The cheapest divorce is an uncontested one, where you and your spouse agree on everything. You can prepare the paperwork yourself and only pay the court fee, but forms that are incomplete or filled out incorrectly can be rejected and cost you time. Hiring an attorney is usually the most expensive route.

A document preparation service like ours sits in between: a low flat fee, and your paperwork is prepared and reviewed for you.

Do I need a lawyer to get divorced in Oklahoma?

No. Oklahoma does not require you to hire an attorney to file for divorce. If you and your spouse agree on the terms, many couples handle an uncontested divorce without one. If you disagree about custody, property, debts, or retirement accounts, or you have questions about your legal rights, you should talk with an attorney. We are not attorneys and cannot give legal advice.

What is an uncontested divorce?

An uncontested divorce is one where both spouses agree on all of the terms, such as dividing property and debts and, if you have children, custody, visitation, and child support. Because there is nothing for the court to decide in a trial, it is faster and much less expensive than a contested divorce.

How long does an uncontested divorce take in Oklahoma?

Without minor children, most of our uncontested divorces are granted in as little as ten days. With minor children, it usually takes 30 to 90 days, depending on the court's schedule and whether the waiting period is waived.

What is Oklahoma's 90-day waiting period?

When a couple has minor children, Oklahoma has an automatic 90-day waiting period before the divorce can be finalized. You can ask the court to waive it. We can prepare that request for an additional $50, but the decision is up to the judge.

Do I have to live in Oklahoma to file for divorce there?

To file in Oklahoma, one spouse generally must have lived in the state for at least six months before filing. If you live somewhere else, give us a call. We have helped clients in Texas, Missouri, and even Hawaii.

What if I can't find my spouse?

You can still get divorced. When your spouse's whereabouts are unknown, notice is published instead of being delivered in person. Our fee for this service is $209.95 plus the court filing fee.

Do you speak Spanish?
